Mrs. G was a 74-year-old, wheelchair-bound passenger on a Fastran bus who suf­fered a fractured right orbital bone (face) and fractured femoral neck (hip) when her wheelchair fell over during bus trip. Fastran admitted liability but challenged damages. The bus company claimed that Mrs. G had pre-existing orbital bone fracture and other chronic medical problems, and that she was not complaining of pain during some of her medical visits.

Mrs. G’s doctors testified that the orbital fracture and femoral neck fracture were directly caused by the fall on the bus. They also testified that her femoral neck fracture could not be surgically repaired, would be causing her pain per­manently, and that the only option was to take powerful narcotic medications for the pain.

Before the trial, Mrs. G offered to settle the case with the bus company for $95,000. The company’s highest offer to settle was $50,000. The jury gave Mrs. G $250,000 for her injuries.
