Two young teens paralyzed by electrified water and drowned near a boat whose battery was being charged.

Two young teens drowned after they were paralyzed by electrified water near a boat whose battery was being charged. The electrified water around the boat was caused by faulty wiring created by the boat owner. Claims of the families were settled and the boat owner promised that he would remove the dock.

On a hot summer day, N and K, two teenaged boys, jumped into the lake near a party boat that was docked at the home of another boy. The son of the man who owned the boat that was docked at their home had plugged the boat into a power source to charge its battery. The third boy's father had changed the wiring of the dock and the extension cord in a way that caused electricity to leak into the water when the boat's battery was being charged. N and K were paralyzed by the electric shock and drowned. The lake was owned by the homeowners association, and the faulty wiring was on the homeowners association's property at the edge of the lake. The families of N and K both brought wrongful death claims against the owner of the boat and the homeowners association. They settled their claims at mediation. However, an important incentive for the families to settle their claims was the promise of the boat owner that he would remove his dock and not maintain a dock for as long as he lived in the neighborhood.

A "wrongful death" occurs when a person is killed due to the negligence or misconduct of another individual, company or entity. An action for wrongful death belongs to the decedent's immediate family members ("beneficiaries").
