Our Process

Your Initial Meeting
We will schedule an appointment for you to come into our office to meet with one or more of our attorneys for a FREE consultation. We will also provide you with a list of things to bring to the appointment that will be helpful in reviewing your potential claim. This meeting will provide an opportunity for us to both review the information and answer any questions that you may have. If, based on our discussions, you would like to retain our firm, we will ask you to sign a Retainer Agreement authorizing our law firm to represent you.

Once you have signed a Retainer Agreement, insurance companies are not allowed to speak to you again. Our firm will contact the insurance companies involved, let them know that you are represented by our firm, and handle their requests for information. 

Your Weiner, Spivey & Miller Case Team
In addition to your attorney, we will assign a legal assistant to your case to ensure that it gets the personalized attention and resources it needs. Together, they will gather the necessary documentation to support your personal injury case, and use our firm's more than 100 years of injury law experience to advocate for your legal rights.

Our firm will obtain a copy of your accident report and conduct a thorough investigation of the events that led to your injury. We will contact and interview witnesses and the police officer who filed the report. Our staff may schedule a visit to the accident scene and, if necessary, have an investigator provide accident reconstruction evidence for your case.

Your Medical Treatment
Your legal team will work closely with you to assemble information about your medical history and current medical care and treatment. We will contact your health care providers to gather all of the medical records that support the extent of the injury. This will include copies of your medical records and reports, hospital records, medical history, and medical bills. 

We will need any information concerning previous injuries and medical conditions that may have been similar to those you suffered in your accident. Information about previous accidents, major illnesses, or current treatment unrelated to your case should also be provided.

You can help move your personal injury case forward by:

  • Keeping all appointments with your health care providers and letting us know of any scheduled/rescheduled appointments
  • Describing fully to your doctor(s) the effects of your injuries
  • Remaining under your doctor's care until the doctor releases you
  • Giving your health insurance information to health care providers who are treating you and following up to ensure your health insurance company is paying your bills as it should
  • Keeping your doctor's bills, prescription receipts, and other expense records and sending them to us promptly

Your Settlement Negotiations
Once you have either completed treatment for your injuries or the doctor can establish what your future condition will be, we will begin negotiating with the insurance company to try to resolve your case without having to file a lawsuit. Your attorney will review settlement offers from the insurance company with you to help you decide what is a fair and equitable settlement of your personal injury case.  

If a settlement offer is not fair, we will file a lawsuit to seek the compensation you deserve. Every case is different and we have achieved significant results, both by settlement and by jury verdict. We will give you our professional, legal advice about your settlement offer, but the final decision whether to settle is yours.
