When you or your family members go to a health care provider, you expect to get the best possible care that person or institution can give.  For example:

1. Surgeons should not leave sponges inside your body after surgery or remove the wrong body part. 

2. Nurses shouldn’t leave the rails down on the side of the bed or dump patients on the floor  when transporting them in wheelchairs. 

3. Prescription drugs should be given correctly.

Especially since you put your trust in your doctor and hospital, injury and death caused by medical errors can be more tragic and have longer-lasting effects than other kinds of injury. 

Unfortunately for the injured victims and their families, medical malpractice cases are also some of the hardest cases to prove in Virginia and the vast majority of those who have been injured or killed have no legal remedy.  Why is that?

1.  Medical malpractice cases are very expensive.  In addition to other costs of litigating a case, most cases required that you have medical testimony from one or more experts. 

2.  Doctors are not required to be perfect, so proving your doctor was “wrong” is not enough. 

3.  Juries want to believe that doctors always do what is right, so convincing them otherwise is a huge challenge.
