Fairfax Brain Injury Lawyers

The Centers for Disease Control and Prevention (CDC) reports that an estimated 1.7 million traumatic brain injuries occur annually. Brain injuries are responsible for about one-third of all deaths in the U.S. caused by injury.

If you or one of your family members has sustained a brain injury, you know it can affect all aspects of life. You understand the expenses associated with treatment, the ongoing care that is necessary and the dramatic change in cognitive function, mood and personality that can occur. In a worst-case scenario, you understand the grief that comes when a loved one dies.

While nothing can undo the damage done, an experienced brain injury attorney at Weiner Spivey & Miller can advocate for the legal rights of you or your loved one who has suffered a brain injury caused by the negligence or wrongdoing of another person or company.

Causes of Head Trauma

Brain injury can occur any time someone suffers an open- or a closed-head wound. Not surprisingly, there are certain types of incidents that are especially likely to cause damage to the brain. For example:

  • Caregiver.org reports that 28 percent are caused by motor vehicle accidents.
  • The Mayo Clinic reports that falls are the most common cause of TBI, especially among kids and the elderly.
  • The Mayo Clinic also indicates that 10 percent result from violence, and especially firearm injuries or assaults.

Other primary causes include sports accidents and recreational accidents such as on an ATV or injury while on a playground.

Traumatic brain injury (TBI)

A severe blow can produce a traumatic brain injury or TBI, which often results in brain swelling or an intracerebral hemorrhage, which is bleeding in the brain tissue.

Even seemingly mild trauma can lead to a brain injury. Symptoms of a brain injury include:

  • Repeated vomiting
  • Convulsions
  • An inability to awaken
  • Headaches
  • Pupil dilation
  • Slurred speech
  • Loss of coordination

Victims of severe TBI can suffer significant cognitive changes in memory, learning, recognition, and other social deficits. Neurological complications from a severe TBI include speech, vision, and hearing problems; weakness in one part of the body; and problems with balance, walking, or the normal use of one’s limbs.

Victims with severe TBI may be unable to return to their usual occupation or to work at all. Long term care and rehabilitation may be necessary, which can cost substantial sums of money.

A mild TBI can include periodic headaches, dizziness, ringing in the ears, mood changes, difficulty sleeping, and fatigue that can be temporary. Moderate TBI symptoms include chronic headaches and nausea and varying degrees of changes in memory, vision, hearing, concentration, and mood or temperament. Victims with moderate TBI may also have difficulties returning to work or to a normal life without considerable treatment and rehabilitation.
