The practice of law can be complicated especially for attorneys who frequently litigate in Court. There are statewide rules of procedure that govern practice in all Virginia courts. In addition, each county court may have its own local rules of procedure. It is extremely important for attorneys to know of the existence of and to be familiar with any local rules that exist in a court where they have a case. Violation of a local rule can be detrimental to the case. Sometimes the local rules are simple and easy to learn, especially in smaller or more rural jurisdictions. The Fairfax County Circuit Court is the largest and busiest trial court in Virginia and is one of the speediest courts in the nation. In order to maintain and improve the efficiency of the court and to assist practitioners and litigants acting on their own, the Fairfax Bar Association in partnership with the Judges and Clerk of the Court have published the Fairfax Circuit Court Practice Manual. The Manual complies and contains information about the Clerk’s office, Criminal and Civil trial and motions practice, Domestic Relations litigation, Probate and Estate administration, Medical Malpractice proceedings, Guardianship and Conservatorship practice, Alternative Dispute Resolution, procedure in other courts in northern Virginia, and numerous other policies and procedures. The Manual is an invaluable resource for any attorney practicing in Fairfax and for anyone who has regular dealings in or with the Fairfax County Circuit Court.
